The American Sustainable Business Coalition has filed a lawsuit against Texas over a 2021 law that restricts state investments in companies that are seen as “boycotting” the fossil fuel industry. The law requires state entities to divest from companies that have reduced ties with the oil and gas sector, prompting criticism from progressive groups who argue that it violates the First and Fourteenth Amendments by discriminating against viewpoints and denying companies due process.
Republican officials who approved the legislation aimed to protect Texas oil and gas companies from financial pressures related to climate risk and divestment from fossil fuels. The law has led to the blacklisting of over 370 investment firms, including major names like BlackRock, which manage significant portions of the state’s funds.
In response to the lawsuit, the Texas Comptroller criticized the attempt to force the state to invest against its values and economic interests, arguing that it aims to push a radical environmental agenda onto companies. The American Sustainable Business Coalition argues that the law infringes on free speech and association rights, penalizes companies for their energy policies, and lacks due process protections.
The lawsuit highlights the ongoing debate between environmental advocates and fossil fuel supporters over investment strategies and policy decisions related to climate change. It raises concerns about the role of government in dictating business practices and the potential consequences for companies that prioritize sustainability in a state heavily reliant on the oil and gas industry.
