Department of Justice files lawsuit against Virginia for purging voter rolls too close to election date

The U.S. Department of Justice sued Virginia for cancelling voter registrations in violation of federal law, which Gov. Glenn Youngkin argues has been state policy for 18 years. The state law allows for removal of voters who identify as noncitizens, but the lawsuit claims that eligible voters are being wrongly removed from the rolls. The department asked a federal judge to restore registrations of voters dropped since August 7, and to train officials to prevent confusion about eligible voters being accused of being noncitizens.

Youngkin defended the policy, stating that it ensures fair elections in Virginia. However, concerns have been raised about eligible citizens being mistakenly removed from the rolls. Postal delays could also impact voters’ ability to respond to notifications within the 14-day deadline.

Studies have shown that noncitizen voting is extremely rare, with only a few cases found out of millions of votes. Despite this, some political parties have made preventing noncitizen voting a priority. The Republican National Committee has filed lawsuits in multiple states to prevent noncitizen voting.

The Justice Department has also filed a similar lawsuit against Alabama over voter registration cancellations. The outcome of these legal challenges could impact voter registration policies and practices across the country.
