Supreme Court refuses stay, grants temporary restraining order as Texas inmate’s execution looms – NBC 5 Dallas-Fort Worth


The Supreme Court denied a stay for Texas death row inmate Robert Roberson III, leaving it up to Gov. Greg Abbott to stop the execution with a 30-day stay. Roberson was convicted in 2003 of shaking his 2-year-old daughter to death, but new evidence suggests he may be innocent. The Texas House Committee on Criminal Jurisprudence unanimously passed a motion to subpoena Roberson, but this alone was not enough to stop the execution. A district judge granted a temporary restraining order, but it is unclear if it will halt the execution. The Texas Attorney General’s Office was expected to appeal the order. If the execution proceeds, Roberson would be the first person in the U.S. executed for a murder conviction tied to shaken baby syndrome. Justice Sonia Sotomayor stated that an executive reprieve could prevent a miscarriage of justice, giving the Board of Pardons and Paroles time to reconsider evidence of Roberson’s innocence. Abbott has the authority to grant pardons and delay executions, but has remained silent on the matter. The U.S. Supreme Court indicated that the only way for Roberson to avoid execution is through the governor. Despite mounting evidence of his innocence, it remains uncertain whether Roberson will be spared from the scheduled lethal injection.
