Ashtian Barnes was shot by Officer Roberto Felix Jr., who claimed he acted out of fear for his life. The lower courts dismissed the excessive force lawsuit, but the Supreme Court is questioning whether the right standard was applied. Barnes’ mother, Janice Hughes, argues that the totality of the circumstances should be considered, rather than just the moment of the threat. Justices appeared concerned about the impact a ruling in favor of Hughes could have on the safety of police officers during traffic stops. The decision could have broad implications for similar cases nationwide. Despite potentially finding Felix in violation of Barnes’ rights, the officer may still be protected from financial liability by qualified immunity. A decision is expected by early summer.
