Physician seeks restraining order in transgender healthcare lawsuit, alleges Texas Attorney General is creating a media controversy

Attorneys representing Dr. M. Brett Cooper, a Dallas doctor being sued by the Texas attorney general under the state’s trans health care law, have filed a request for a gag order in the case. They accuse Attorney General Ken Paxton of turning the lawsuit into a “politicized media spectacle.” Cooper is one of three doctors facing lawsuits for allegedly providing gender-affirming care to minors, which is banned in Texas under a law that took effect in 2023.

The attorneys argue that Paxton’s public statements about the case could influence public opinion before the case has been tried and potentially harm innocent patients. They are asking for a gag order to prevent any false statements about the case and to limit publicized “extrajudicial statements” by all attorneys involved.

Cooper’s attorneys are also requesting a change of venue for the case, claiming that the current court may be biased. Similar motions have been filed for the other two doctors being sued in different counties. Despite requests for comment, the attorney general’s office has not responded.

The case highlights the controversial issue of gender-affirming care for minors in Texas and the legal battles that have emerged as a result of the state’s ban on such treatments. The outcome of these lawsuits could have far-reaching implications for the rights of transgender individuals and the medical professionals who care for them.
