The U.S. 5th Circuit Court of Appeals has overturned the death sentence of Brittany Marlowe Holberg after finding that local prosecutors failed to disclose that their key witness was a paid informant. Holberg has been on death row for 27 years since her 1998 murder conviction for killing an 80-year-old man. The informant recanted her testimony in 2011, leading the appeals court to send the case back to the trial court for further proceedings.
The court ruled that the prosecution violated Holberg’s due process rights by withholding information that should have been disclosed. Holberg maintained that she acted in self-defense due to severe childhood abuse and a crack cocaine addiction. The prosecution presented testimony from a jail cellmate who was also a police informant, without disclosing this fact to the jury.
In a lone dissent, Judge Stuart Kyle Duncan argued that the conviction was based on graphic physical evidence against Holberg and not solely on the informant’s testimony. The decision has prompted discussions on the flaws in the criminal justice system and the ongoing debate on capital punishment.
Randall County District Attorney Robert Love expressed disappointment over the ruling and is waiting on the Texas Office of the Attorney General to decide on the next legal steps. Holberg’s attorneys have yet to comment on the decision. The case highlights the complexities and challenges faced in the justice system, particularly in capital punishment cases.
