Texas bill proposes criminal charges for individuals accused of committing ‘gender identity fraud’


A new bill in Texas, House Bill 3817, has been introduced that could criminalize transgender individuals for identifying with a gender different from their sex assigned at birth. Filed by state Rep. Tom Oliverson, R-Cypress, the bill would make it a felony for someone to knowingly provide false or misleading information about their assigned sex to government entities or private employers. Those found guilty could face up to two years in jail and a fine of up to $10,000.

If passed, the bill would go into effect on Sept. 1, 2025. However, the chances of the bill passing are slim, as it is considered a low priority in the state House. The bill currently has no co-sponsors and has not been scheduled for a committee hearing.
